The dual system is based on the German Packaging Ordinance, the VerpackV, which came into force on 12 June 1991 and aims to prevent and recycle waste packaging. The 5th amendment to the Packaging Ordinance then came into force on 5 April 2008. As a result of the amended ordinance, "Erstinverkehrbringer"* of sales packaging are now obliged to participate in a dual system for all their packaging that ends up at final consumers.

The system was termed "dual" because it exists alongside or rather in addition to the municipal waste collection system.
